These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at aone.id and app.aoneschools.com (together or individually “Service”) operated by My AOne Learning Sdn Bhd. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them. If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply. 5. SUBSCRIPTIONS	5. LANGGANAN
Some parts of Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or My AOne Learning Sdn Bhd cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting [email protected] customer support team. A valid payment method is required to process the payment for your subscription. You shall provide My AOne Learning Sdn Bhd with accurate and complete billing information that may include but not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize My AOne Learning Sdn Bhd to charge all Subscription fees incurred through your account to any such payment instruments. Should automatic billing fail to occur for any reason, My AOne Learning Sdn Bhd reserves the right to terminate your access to the Service with immediate effect.	Beberapa bagian dari Layanan ditagihkan berdasarkan sistem berlangganan (“Langganan”). Anda akan ditagihkan di muka secara berulang dan berkala (“Siklus Penagihan”). Anda dapat membatalkan perpanjangan Langganan Anda baik melalui halaman pengelolaan akun online Anda atau dengan menghubungi tim bantuan pelanggan melalui [email protected]. Metode pembayaran yang sah diperlukan untuk memproses pembayaran Langganan Anda. Anda wajib memberikan kepada My AOne Learning Sdn Bhd informasi penagihan yang akurat dan lengkap, yang dapat mencakup namun tidak terbatas pada nama lengkap, alamat, provinsi, kode pos, nomor telepon, serta informasi metode pembayaran yang sah. Dengan menyerahkan informasi pembayaran tersebut, Anda secara otomatis memberikan wewenang kepada My AOne Learning Sdn Bhd untuk membebankan seluruh biaya Langganan yang timbul melalui akun Anda ke instrumen pembayaran tersebut. Apabila penagihan otomatis gagal dilakukan karena alasan apa pun, My AOne Learning Sdn Bhd berhak untuk menghentikan akses Anda ke Layanan dengan segera.


6. FEE CHANGES	6. PERUBAHAN BIAYA
My AOne Learning Sdn Bhd, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. My AOne Learning Sdn Bhd will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.	My AOne Learning Sdn Bhd, atas kebijakannya sendiri dan kapan saja, dapat mengubah biaya Langganan untuk Langganan tersebut. Setiap perubahan biaya Langganan akan mulai berlaku pada akhir Siklus Penagihan yang sedang berjalan. My AOne Learning Sdn Bhd akan memberikan pemberitahuan sebelumnya yang wajar kepada Anda atas setiap perubahan biaya Langganan agar Anda memiliki kesempatan untuk menghentikan Langganan Anda sebelum perubahan tersebut berlaku. Penggunaan Layanan secara berkelanjutan oleh Anda setelah perubahan biaya Langganan mulai berlaku merupakan persetujuan Anda untuk membayar jumlah biaya Langganan yang telah diubah tersebut.


7. CONTENT	7. KONTEN
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness. By posting Content on or through Service, You represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright. You retain any and all of your rights to any Content you submit, post or display on or through Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through Service. However, by posting Content using Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through Service. You agree that this license includes the right for us to make your Content available to other users of Service, who may also use your Content subject to these Terms. My AOne Learning Sdn Bhd has the right but not the obligation to monitor and edit all Content provided by users. In addition, Content found on or through this Service are the property of My AOne Learning Sdn Bhd or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of My AOne Learning Sdn Bhd and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of My AOne Learning Sdn Bhd.	Layanan dan konten organik Layanan (tidak termasuk Konten yang disediakan oleh pengguna), fitur, dan fungsionalitasnya adalah dan akan tetap menjadi milik eksklusif My AOne Learning Sdn Bhd beserta pemberi lisensinya. You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose. These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at aone.id and app.aoneschools.com (together or individually “Service”) operated by My AOne Learning Sdn Bhd.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

5. SUBSCRIPTIONS

“Some parts of Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or My AOne Learning Sdn Bhd cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting [email protected] customer support team.

A valid payment method is required to process the payment for your subscription. You shall provide My AOne Learning Sdn Bhd with accurate and complete billing information that may include but not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize My AOne Learning Sdn Bhd to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, My AOne Learning Sdn Bhd reserves the right to terminate your access to the Service with immediate effect.”

6. FEE CHANGES

“My AOne Learning Sdn Bhd, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

My AOne Learning Sdn Bhd will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.”

7. CONTENT

“Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

8.13. Attack Service via a denial-of-service attack or a distributed denial-of-service attack.

8.14. Take any action that may damage or falsify Company rating.

8.15. Otherwise attempt to interfere with the proper working of Service.

9. ANALYTICS

We may use third-party Service Providers to monitor and analyze the use of our Service.

10. NO USE BY MINORS

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

11. ACCOUNTS

“When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of My AOne Learning Sdn Bhd and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of My AOne Learning Sdn Bhd.

13. ERROR REPORTING AND FEEDBACK

You may provide us either directly at [email protected] or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. 17. TERMINATION

We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

1. PENDAHULUAN

“Selamat datang di My AOne Learning Sdn Bhd (“Perusahaan”, “kami”, “milik kami”, “kita”)!

Syarat Layanan ini (“Syarat”, “Syarat Layanan”) mengatur penggunaan Anda atas situs web kami yang beralamat di aone.id dan app.aoneschools.com (secara bersama-sama atau masing-masing disebut sebagai “Layanan”) yang dioperasikan oleh My AOne Learning Sdn Bhd.

Kebijakan Privasi kami juga mengatur penggunaan Anda atas Layanan kami dan menjelaskan bagaimana kami mengumpulkan, melindungi, serta mengungkapkan informasi yang dihasilkan dari penggunaan halaman web kami.

Perjanjian Anda dengan kami mencakup Syarat ini dan Kebijakan Privasi kami (“Perjanjian”). Anda menyatakan bahwa Anda telah membaca dan memahami Perjanjian tersebut, serta setuju untuk terikat olehnya.

3. PEMBELIAN

“Jika Anda ingin membeli produk atau layanan apa pun yang tersedia melalui Layanan (“Pembelian”), Anda mungkin akan diminta untuk memberikan informasi tertentu yang relevan dengan Pembelian Anda, termasuk namun tidak terbatas pada nama perusahaan Anda, nomor pendaftaran perusahaan, nama direktur, dan nomor IC direktur.

4. PROMOSI

Setiap promosi (secara bersama-sama disebut sebagai “Promosi”) yang tersedia melalui Layanan dapat diatur oleh ketentuan yang terpisah dari Syarat Layanan ini. Jika Anda berpartisipasi dalam Promosi apa pun, harap meninjau ketentuan yang berlaku serta Kebijakan Privasi kami. Apabila ketentuan Promosi bertentangan dengan Syarat Layanan ini, maka ketentuan Promosi yang akan berlaku.

5. LANGGANAN

“Beberapa bagian dari Layanan ditagihkan berdasarkan sistem berlangganan (“Langganan”). Anda akan ditagihkan di muka secara berulang dan berkala (“Siklus Penagihan”). Siklus penagihan akan ditetapkan berdasarkan jenis paket langganan yang Anda pilih saat melakukan pembelian Langganan.

Pada akhir setiap Siklus Penagihan, Langganan Anda akan diperpanjang secara otomatis dengan ketentuan yang sama persis kecuali Anda membatalkannya atau My AOne Learning Sdn Bhd membatalkannya. Anda dapat membatalkan perpanjangan Langganan Anda baik melalui halaman pengelolaan akun online Anda atau dengan menghubungi tim bantuan pelanggan melalui [email protected].

Metode pembayaran yang sah diperlukan untuk memproses pembayaran Langganan Anda. Anda wajib memberikan kepada My AOne Learning Sdn Bhd informasi penagihan yang akurat dan lengkap, yang dapat mencakup namun tidak terbatas pada nama lengkap, alamat, provinsi, kode pos, nomor telepon, serta informasi metode pembayaran yang sah. Dengan menyerahkan informasi pembayaran tersebut, Anda secara otomatis memberikan wewenang kepada My AOne Learning Sdn Bhd untuk membebankan seluruh biaya Langganan yang timbul melalui akun Anda ke instrumen pembayaran tersebut.

Apabila penagihan otomatis gagal dilakukan karena alasan apa pun, My AOne Learning Sdn Bhd berhak untuk menghentikan akses Anda ke Layanan dengan segera.”

6. PERUBAHAN BIAYA

“My AOne Learning Sdn Bhd, atas kebijakannya sendiri dan kapan saja, dapat mengubah biaya Langganan untuk Langganan tersebut. Setiap perubahan biaya Langganan akan mulai berlaku pada akhir Siklus Penagihan yang sedang berjalan.

My AOne Learning Sdn Bhd akan memberikan pemberitahuan sebelumnya yang wajar kepada Anda atas setiap perubahan biaya Langganan agar Anda memiliki kesempatan untuk menghentikan Langganan Anda sebelum perubahan tersebut berlaku.

Penggunaan Layanan secara berkelanjutan oleh Anda setelah perubahan biaya Langganan mulai berlaku merupakan persetujuan Anda untuk membayar jumlah biaya Langganan yang telah diubah tersebut.”

7. KONTEN

“Layanan kami memungkinkan Anda untuk memposting, menautkan, menyimpan, membagikan, dan dengan cara lain menyediakan informasi, teks, grafik, video, atau materi lainnya (“Konten”). Anda bertanggung jawab atas Konten yang Anda posting di atau melalui Layanan, termasuk legalitas, keandalan, dan kesesuaiannya.

Dengan memposting Konten di atau melalui Layanan, Anda menyatakan dan menjamin bahwa: (i) Konten tersebut adalah milik Anda (Anda memilikinya) dan/atau Anda memiliki hak untuk menggunakannya serta hak untuk memberikan kepada kami hak dan lisensi sebagaimana diatur dalam Syarat ini; dan (ii) pemostingan Konten Anda di atau melalui Layanan tidak melanggar hak privasi, hak publikasi, hak cipta, hak kontraktual, atau hak lainnya dari individu atau entitas mana pun. Kami berhak untuk menghentikan akun siapa pun yang terbukti melanggar hak cipta.

Anda tetap memiliki seluruh hak atas setiap Konten yang Anda kirimkan, posting, atau tampilkan di atau melalui Layanan dan Anda bertanggung jawab untuk melindungi hak-hak tersebut. Kami tidak bertanggung jawab dan tidak menanggung kewajiban apa pun atas Konten yang Anda atau pihak ketiga posting di atau melalui Layanan. Namun, dengan memposting Konten melalui Layanan, Anda memberikan kepada kami hak dan lisensi untuk menggunakan, memodifikasi, menampilkan secara publik, mempertunjukkan secara publik, mereproduksi, dan mendistribusikan Konten tersebut di dan melalui Layanan. Anda menyetujui bahwa lisensi ini mencakup hak bagi kami untuk menyediakan Konten Anda kepada pengguna Layanan lainnya, yang juga dapat menggunakan Konten Anda sesuai dengan Syarat ini.

My AOne Learning Sdn Bhd memiliki hak, namun tidak berkewajiban, untuk memantau dan menyunting seluruh Konten yang disediakan oleh pengguna.

Selain itu, Konten yang ditemukan di atau melalui Layanan ini merupakan milik My AOne Learning Sdn Bhd atau digunakan dengan izin. Anda tidak diperkenankan untuk mendistribusikan, memodifikasi, mentransmisikan, menggunakan kembali, mengunduh, memposting ulang, menyalin, atau menggunakan Konten tersebut, baik seluruhnya maupun sebagian, untuk tujuan komersial atau keuntungan pribadi, tanpa izin tertulis sebelumnya dari kami.”

8. PENGGUNAAN YANG DILARANG

Anda hanya diperkenankan menggunakan Layanan untuk tujuan yang sah dan sesuai dengan Syarat ini. Anda setuju untuk tidak menggunakan Layanan:

8.1. Dengan cara apa pun yang melanggar hukum atau peraturan nasional maupun internasional yang berlaku.

8.2. Untuk tujuan mengeksploitasi, membahayakan, atau mencoba mengeksploitasi atau membahayakan anak di bawah umur dengan cara apa pun, termasuk dengan memaparkan mereka pada konten yang tidak pantas atau cara lainnya.

8.3. Untuk mengirimkan, atau mengupayakan pengiriman, materi periklanan atau promosi apa pun, termasuk “junk mail”, “chain letter”, “spam”, atau bentuk permintaan serupa lainnya.

8.4. Untuk menyamar atau mencoba menyamar sebagai Perusahaan, karyawan Perusahaan, pengguna lain, atau individu maupun entitas lainnya.

8.5. Dengan cara apa pun yang melanggar hak pihak lain, atau dengan cara apa pun yang bersifat melanggar hukum, mengancam, menipu, atau merugikan, atau yang terkait dengan tujuan atau aktivitas yang melanggar hukum, ilegal, menipu, atau merugikan.

8.6. Untuk melakukan tindakan lain apa pun yang membatasi atau menghambat penggunaan atau kenikmatan Layanan oleh siapa pun, atau yang menurut penilaian kami dapat merugikan atau menyinggung Perusahaan atau pengguna Layanan, atau menimbulkan tanggung jawab hukum bagi mereka.

Selain itu, Anda setuju untuk tidak:

8.7. Menggunakan Layanan dengan cara apa pun yang dapat menonaktifkan, membebani secara berlebihan, merusak, atau mengganggu Layanan, atau mengganggu penggunaan Layanan oleh pihak lain, termasuk kemampuan mereka untuk melakukan aktivitas secara waktu nyata melalui Layanan.

8.8. Menggunakan robot, spider, atau perangkat, proses, atau sarana otomatis lainnya untuk mengakses Layanan dengan tujuan apa pun, termasuk memantau atau menyalin materi apa pun yang terdapat dalam Layanan.

8.9. Menggunakan proses manual apa pun untuk memantau atau menyalin materi apa pun yang terdapat dalam Layanan atau untuk tujuan tidak sah lainnya tanpa persetujuan tertulis sebelumnya dari kami.

8.10. Menggunakan perangkat, perangkat lunak, atau rutinitas apa pun yang mengganggu berfungsinya Layanan secara semestinya.

8.11. Memasukkan virus, trojan horse, worm, logic bomb, atau materi lain apa pun yang bersifat berbahaya atau merugikan secara teknologi.

8.12. Mencoba memperoleh akses tidak sah, mengganggu, merusak, atau mengacaukan bagian manapun dari Layanan, server tempat Layanan disimpan, atau server, komputer, atau basis data apa pun yang terhubung dengan Layanan.

8.13. Menyerang Layanan melalui serangan penolakan layanan (denial-of-service) atau serangan penolakan layanan terdistribusi (distributed denial-of-service).

8.14. Melakukan tindakan apa pun yang dapat merusak atau memalsukan penilaian rating terhadap Perusahaan.

8.15. Dengan cara lain mencoba mengganggu berfungsinya Layanan secara semestinya.

9. ANALITIK

Kami dapat menggunakan Penyedia Layanan pihak ketiga untuk memantau dan menganalisis penggunaan Layanan kami.

10. LARANGAN PENGGUNAAN UNTUK ANAK DI BAWAH UMUR

Layanan ini hanya ditujukan untuk diakses dan digunakan oleh individu yang berusia minimal delapan belas (18) tahun. Dengan mengakses atau menggunakan Layanan, Anda menyatakan dan menjamin bahwa Anda berusia setidaknya delapan belas (18) tahun dan memiliki wewenang, hak, dan kapasitas penuh untuk masuk ke dalam perjanjian ini serta mematuhi semua syarat dan ketentuan Syarat ini. Jika Anda belum berusia minimal delapan belas (18) tahun, Anda dilarang mengakses maupun menggunakan Layanan.

11. AKUN

“Saat Anda membuat akun dengan kami, Anda menjamin bahwa Anda berusia di atas 18 tahun, dan bahwa informasi yang Anda berikan kepada kami akurat, lengkap, dan selalu terkini. Informasi yang tidak akurat, tidak lengkap, atau usang dapat mengakibatkan penghentian akun Anda di Layanan secara langsung.

Anda bertanggung jawab untuk menjaga kerahasiaan akun dan kata sandi Anda, termasuk namun tidak terbatas pada pembatasan akses ke komputer dan/atau akun Anda. Anda setuju untuk bertanggung jawab atas semua aktivitas atau tindakan yang terjadi di bawah akun dan/atau kata sandi Anda, baik kata sandi Anda digunakan di Layanan kami maupun di layanan pihak ketiga. Anda harus segera memberi tahu kami apabila mengetahui adanya pelanggaran keamanan atau penggunaan akun Anda yang tidak sah.

Anda tidak diperkenankan menggunakan sebagai nama pengguna nama orang atau entitas lain, atau nama yang secara hukum tidak tersedia untuk digunakan, nama atau merek dagang yang menjadi hak orang atau entitas lain selain Anda, tanpa izin yang sesuai. Anda juga tidak diperkenankan menggunakan sebagai nama pengguna nama yang menyinggung, vulgar, atau tidak senonoh.

Kami berhak untuk menolak layanan, menghentikan akun, menghapus atau menyunting konten, atau membatalkan pesanan atas kebijakan kami sendiri.”

12. HAK KEKAYAAN INTELEKTUAL

Layanan dan konten organik Layanan (tidak termasuk Konten yang disediakan oleh pengguna), fitur, dan fungsionalitasnya adalah dan akan tetap menjadi milik eksklusif My AOne Learning Sdn Bhd beserta pemberi lisensinya. Layanan ini dilindungi oleh undang-undang hak cipta, merek dagang, dan undang-undang lainnya baik di dalam negeri maupun luar negeri. Merek dagang kami tidak boleh digunakan sehubungan dengan produk atau layanan apa pun tanpa persetujuan tertulis sebelumnya dari My AOne Learning Sdn Bhd.

13. PENYAMPAIAN GANGGUAN DAN MASUKAN

“Anda dapat memberikan kami informasi dan masukan mengenai kesalahan, saran perbaikan, ide, masalah, keluhan, dan hal lainnya yang terkait dengan Layanan kami (“Masukan”) baik secara langsung di [email protected]
maupun melalui situs dan alat pihak ketiga. Anda mengakui dan menyetujui bahwa: (i) Anda tidak akan mempertahankan, memperoleh, atau mengklaim hak kekayaan intelektual atau hak, kepemilikan, atau kepentingan lain atas Masukan; (ii) Perusahaan mungkin memiliki ide pengembangan yang serupa dengan Masukan; (iii) Masukan tidak mengandung informasi rahasia atau informasi kepemilikan dari Anda atau pihak ketiga mana pun; dan (iv) Perusahaan tidak memiliki kewajiban kerahasiaan terkait Masukan. Apabila pengalihan kepemilikan atas Masukan tidak memungkinkan karena hukum wajib yang berlaku, Anda memberikan kepada Perusahaan dan afiliasinya hak eksklusif, dapat dialihkan, tidak dapat dibatalkan, gratis, dapat disublisensikan, tanpa batas, dan permanen untuk menggunakan (termasuk menyalin, memodifikasi, membuat karya turunan, menerbitkan, mendistribusikan, dan mengkomersialkan) Masukan dengan cara apa pun dan untuk tujuan apa pun.”

14. TAUTAN KE SITUS LAIN

“Layanan kami mungkin berisi tautan ke situs web atau layanan pihak ketiga yang bukan dimiliki atau dikendalikan oleh My AOne Learning Sdn Bhd.

My AOne Learning Sdn Bhd tidak memiliki kendali atas, dan tidak bertanggung jawab atas, konten, kebijakan privasi, atau praktik dari situs web atau layanan pihak ketiga mana pun. Kami tidak menjamin penawaran dari entitas/individu tersebut atau situs web mereka.

ANDA MENGAKUI DAN MENYETUJUI BAHWA PERUSAHAAN TIDAK AKAN BERTANGGUNG JAWAB, SECARA LANGSUNG MAUPUN TIDAK LANGSUNG, ATAS KERUGIAN ATAU KERUSAKAN APA PUN YANG DISEBABKAN ATAU DIDUGA DISEBABKAN OLEH ATAU SEHUBUNGAN DENGAN PENGGUNAAN ATAU KETERGANTUNGAN PADA KONTEN, BARANG, ATAU LAYANAN APA PUN YANG TERSEDIA DI ATAU MELALUI SITUS WEB ATAU LAYANAN PIHAK KETIGA TERSEBUT.

KAMI SANGAT MENYARANKAN AGAR ANDA MEMBACA SYARAT LAYANAN DAN KEBIJAKAN PRIVASI DARI SITUS WEB ATAU LAYANAN PIHAK KETIGA MANAPUN YANG ANDA KUNJUNGI.”

15. PENAFIAN JAMINAN

“LAYANAN INI DISEDIAKAN OLEH PERUSAHAAN BERDASARKAN “SEBAGAIMANA ADANYA” DAN “SEBAGAIMANA TERSEDIA”. PERUSAHAAN TIDAK MEMBERIKAN PERNYATAAN ATAU JAMINAN APA PUN, BAIK SECARA TERSURAT MAUPUN TERSIRAT, TERKAIT OPERASI LAYANANNYA, ATAU INFORMASI, KONTEN, ATAU MATERI YANG TERKAIT DI DALAMNYA. ANDA SECARA TEGAS SETUJU BAHWA PENGGUNAAN ANDA ATAS LAYANAN INI, KONTENNYA, DAN LAYANAN ATAU ITEM APA PUN YANG DIPEROLEH DARI KAMI ADALAH SEPENUHNYA ATAS RISIKO ANDA SENDIRI.

PERUSAHAAN MAUPUN PIHAK YANG TERKAIT DENGAN PERUSAHAAN TIDAK MEMBERIKAN JAMINAN ATAU PERNYATAAN APAPUN TERKAIT KELENGKAPAN, KEAMANAN, KEANDALAN, KUALITAS, KETEPATAN, ATAU KETERSEDIAAN LAYANAN. TANPA MEMBATASI HAL TERSEBUT, BAIK PERUSAHAAN MAUPUN PIHAK YANG TERKAIT DENGAN PERUSAHAAN TIDAK MENYATAKAN ATAU MENJAMIN BAHWA LAYANAN, KONTENNYA, ATAU LAYANAN ATAU ITEM APA PUN YANG DIPEROLEH MELALUI LAYANAN AKAN AKURAT, TERPERCAYA, BEBAS DARI KESALAHAN, ATAU TIDAK TERGANGGU, BAHWA CACAT AKAN DIPERBAIKI, BAHWA LAYANAN ATAU SERVER YANG MENYEDIAKAN BEBAS DARI VIRUS ATAU KOMPONEN BERBAHAYA LAIN, ATAU BAHWA LAYANAN ATAU LAYANAN ATAU ITEM APA PUN YANG DIPEROLEH MELALUI LAYANAN AKAN MEMENUHI KEBUTUHAN ATAU HARAPAN ANDA.

PERUSAHAAN DENGAN INI MENOLAK SELURUH JAMINAN DARI JENIS APA PUN, BAIK YANG TERSURAT MAUPUN TERSIRAT, YANG DIATUR OLEH UNDANG-UNDANG ATAU LAINNYA, TERMASUK NAMUN TIDAK TERBATAS PADA JAMINAN KELAYAKAN DIPERDAGANGKAN, TIDAK MELANGGAR HAK PIHAK LAIN, DAN KECOCOKAN UNTUK TUJUAN TERTENTU.

PERNYATAAN DI ATAS TIDAK MEMPENGARUHI JAMINAN APA PUN YANG TIDAK DAPAT DIKECUALIKAN ATAU DIBATASI MENURUT HUKUM YANG BERLAKU.”

16. BATASAN TANGGUNG JAWAB

KECUALI DILARANG OLEH HUKUM, ANDA SETUJU UNTUK MEMBEBASKAN KAMI SERTA PEJABAT, DIREKTUR, KARYAWAN, DAN AGEN KAMI DARI TANGGUNG JAWAB ATAS KERUGIAN TIDAK LANGSUNG, PUNITIF, KHUSUS, INSIDENTAL, ATAU KONSEKUENSIAL, BAGAIMANAPUN TERJADINYA (TERMASUK BIAYA PENGACARA DAN SELURUH BIAYA DAN PENGELUARAN TERKAIT LITIGASI DAN ARBITRASE, ATAU PADA SIDANG ATAU BANDING, JIKA ADA, BAIK LITIGASI ATAU ARBITRASE DILAKSANAKAN ATAU TIDAK), BAIK DALAM TINDAKAN KONTRAK, KELALAIAN, ATAU TINDAKAN TORT LAINNYA, ATAU YANG TIMBUL DARI ATAU SEHUBUNGAN DENGAN PERJANJIAN INI, TERMASUK NAMUN TIDAK TERBATAS PADA KLAIM ATAS CEDERA PRIBADI ATAU KERUSAKAN PROPERTI, YANG TIMBUL DARI PERJANJIAN INI DAN SETIAP PELANGGARAN OLEH ANDA TERHADAP HUKUM FEDERAL, NEGARA BAGIAN, ATAU DAERAH, STATUTA, PERATURAN, ATAU KETENTUAN, MESKIPUN PERUSAHAAN TELAH DIBERITAHU SEBELUMNYA TENTANG KEMUNGKINAN KERUGIAN TERSEBUT. KECUALI DILARANG OLEH HUKUM, JIKA TERDAPAT TANGGUNG JAWAB YANG DIBEBANKAN KEPADA PERUSAHAAN, MAKA TANGGUNG JAWAB TERSEBUT TERBATAS PADA JUMLAH YANG DIBAYARKAN UNTUK PRODUK DAN/ATAU LAYANAN, DAN DALAM KONDISI APAPUN TIDAK AKAN ADA KERUGIAN KONSEKUENSIAL ATAU PUNITIF. BEBERAPA NEGARA BAGIAN TIDAK MENGIZINKAN PENGECUALIAN ATAU BATASAN ATAS KERUGIAN PUNITIF, INSIDENTAL, ATAU KONSEKUENSIAL, SEHINGGA BATASAN ATAU PENGECUALIAN TERSEBUT MUNGKIN TIDAK BERLAKU UNTUK ANDA.

17. PENGHENTIAN

“Kami dapat menghentikan atau menangguhkan akun Anda serta memblokir akses ke Layanan secara segera, tanpa pemberitahuan atau tanggung jawab sebelumnya, atas kebijakan kami sendiri, dengan alasan apa pun dan tanpa batasan, termasuk namun tidak terbatas pada pelanggaran Syarat.

Jika Anda ingin menghentikan akun Anda, Anda dapat berhenti menggunakan Layanan.

Semua ketentuan dalam Syarat yang secara sifatnya seharusnya tetap berlaku setelah penghentian akan tetap berlaku, termasuk, tanpa batasan, ketentuan kepemilikan, penafian jaminan, ganti rugi, dan batasan tanggung jawab.”

18. HUKUM YANG MENGATUR

“Syarat ini akan diatur dan ditafsirkan sesuai dengan hukum Malaysia, yang menjadi hukum yang berlaku atas perjanjian ini tanpa memperhatikan ketentuan konflik hukumnya.

Kegagalan kami untuk menegakkan hak atau ketentuan apa pun dalam Syarat ini tidak akan dianggap sebagai pengabaian atas hak tersebut. Jika suatu ketentuan dalam Syarat ini dinyatakan tidak sah atau tidak dapat diberlakukan oleh pengadilan, ketentuan lainnya tetap berlaku. Syarat ini merupakan keseluruhan perjanjian antara kami terkait Layanan kami dan menggantikan serta meniadakan semua perjanjian sebelumnya yang mungkin pernah ada antara kami terkait Layanan.”

19. PERUBAHAN LAYANAN

Kami berhak untuk menarik atau mengubah Layanan kami, serta layanan atau materi apa pun yang kami sediakan melalui Layanan, atas kebijakan kami sendiri tanpa pemberitahuan. Kami tidak akan bertanggung jawab jika untuk alasan apa pun seluruh atau sebagian Layanan tidak tersedia pada suatu waktu atau selama suatu periode. Dari waktu ke waktu, kami dapat membatasi akses ke beberapa bagian Layanan, atau seluruh Layanan, bagi pengguna, termasuk pengguna yang terdaftar.

20. PERUBAHAN SYARAT

“Kami dapat mengubah Syarat kapan saja dengan memposting Syarat yang telah diubah di situs ini. Merupakan tanggung jawab Anda untuk meninjau Syarat ini secara berkala.

Penggunaan Platform secara berkelanjutan oleh Anda setelah Syarat yang telah direvisi diposting berarti Anda menerima dan menyetujui perubahan tersebut. Anda diharapkan untuk memeriksa halaman ini secara rutin agar mengetahui setiap perubahan, karena perubahan tersebut mengikat Anda.

Dengan terus mengakses atau menggunakan Layanan kami setelah revisi menjadi efektif, Anda setuju untuk terikat oleh syarat yang telah direvisi. Jika Anda tidak setuju dengan syarat baru tersebut, Anda tidak lagi berwenang untuk menggunakan Layanan.”

21. PEMBEBASAN DAN KETERPISAHAN KETENTUAN

“Tidak ada pengabaian oleh Perusahaan terhadap syarat atau ketentuan apa pun yang tercantum dalam Syarat yang akan dianggap sebagai pengabaian lebih lanjut atau berkelanjutan terhadap syarat atau ketentuan tersebut, atau pengabaian terhadap syarat atau ketentuan lainnya, dan kegagalan Perusahaan untuk menegakkan hak atau ketentuan di bawah Syarat tidak akan dianggap sebagai pengabaian atas hak atau ketentuan tersebut.

Jika suatu ketentuan dalam Syarat dinyatakan oleh pengadilan atau tribunal lain yang berwenang sebagai tidak sah, ilegal, atau tidak dapat diberlakukan karena alasan apa pun, ketentuan tersebut akan dihapus atau dibatasi sejauh minimum yang diperlukan sehingga ketentuan lainnya dalam Syarat tetap berlaku sepenuhnya dan efektif.”

22. PENGAKUAN

DENGAN MENGGUNAKAN LAYANAN ATAU LAYANAN LAIN YANG DISEDIAKAN OLEH KAMI, ANDA MENGAKUI BAHWA ANDA TELAH MEMBACA SYARAT LAYANAN INI DAN SETUJU UNTUK TERIKAT OLEHNYA.
